The so called “Cura Italia” converted Italian Law Decree extends the validity of Italian IP titles expiring between 31 January and 31 July 2020

Please note that, with the recent conversion of the so-called “Cura Italia” Italian Law Decree  into Italian Law no. 27/2020, the validity of Italian industrial property rights expiring between 31 January and 31 July 2020 has been extended.

Article 103(2) of the converted Decree, in fact, states that “All certificates, attestations, permits, concessions, authorizations and enabling acts however denominated (…), expiring between January 31, 2020 and July 31, 2020, shall remain valid for ninety days following the declaration of cessation of the state of pandemic emergency (…)”.

In this regard, the Italian Patent and Trademark Office has specified that this provision also includes Italian industrial property titles and that, with reference to these, upon expiry of the 90-day term, it will be the responsibility of those who intend to extend the duration of an industrial property title to proceed with payments, in the forms already provided for by Italian law, in order to maintain or renew it.
